Consumer group seeks provisional seizures of BMW assets amid class action lawsuit

A consumer group currently engaged in a class action against BMW for a series of fire accidents has decided to seek the provisional seizure of BMW Korea’s assets.

Heon, the law firm acting as an advisor to the Korea Consumer Association, the organization which filed the lawsuit, stated on Aug. 21, “We plan to seek the provisional seizure of BMW Korea’s assets, including the buildings and usage rights to the BMW Driving Centers in Incheon and Yeongjong

Gu Bon-seung, the lawyer representing the association, stated, “The number of claimants in this class action is growing exponentially, and if we win, the damages are likely to amount to several tens of billions of won. Accordingly, we are seeking the provisional seizure of assets to secure our rights as creditors.”

As of Aug. 20, 1,500 claimants had signed up with Heon to join the case. Heon is accepting claims up until Aug. 24, which means the number of claimants for the preliminary lawsuit is likely to exceed 2,000. “We aim to sign individual contracts with each claimant by the end of the week, and file the petition by the end of August,” Gu said.

The KCA has put together a technical support team consisting of 30 individuals including professors and automobile experts, technicians and mechanics, as well as a BMW lawsuit team consisting of lawyers specializing in claiming indemnity rights against insurers.
